End-User Licence Agreement (EULA)

Early-access notice: EnduCloud is live and under active development. Features, metrics and plans change as we learn, and we do not offer a service-level guarantee on either tier at this stage (Section 4). Nothing in these Terms affects the rights you have as a consumer under mandatory law.
Please read these Terms carefully. By creating an account or using EnduCloud you confirm that you have read, understood, and agreed to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the service.

1. Parties & Acceptance

These Terms of Use ("Terms") constitute a legally binding agreement between:

Your acceptance, and your health screening answers, are recorded with a timestamp and version in our systems. Version 1.2 of these Terms applies to acceptances recorded on or after September 1, 2026; version 1.1 applied from July 10, 2026 and version 1.0 from March 12, 2026. Version 1.2 is a material revision (Section 13): every user is asked to accept it again, and to complete the health screening, on their next sign-in.

EnduCloud is a sports performance analytics platform that provides:

3. Licence Grant

Subject to your compliance with these Terms, EnduCloud grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the EnduCloud application for your personal, non-commercial purposes only.

4a. Pricing & Founding-User Benefits

Premium adds the compute-intensive features (AI plan generation and adaptation, the AI morning briefing, unlimited Coach Endy) and unlimited Live Guided Workouts. The free tier is intended to remain genuinely useful: your dashboard, training-load metrics, readiness, history, device sync, and the workout and plan library. Current prices and tier contents are shown in the app before any purchase.

We will never charge you automatically. Moving to a paid plan always requires an explicit action by you, and we will give clear notice before the first charge applies to any account. Until paid plans start, everyone uses EnduCloud at no cost.

These benefits are personal to your account and are not transferable. Prices and tier contents may change; a change never applies to a period you have already paid for.

5. Fitness, Health Screening & Your Responsibility

Important: EnduCloud is a sports analytics tool. It is not a medical device, and nothing within the service constitutes medical advice, clinical diagnosis, treatment, or professional coaching.

All metrics, scores, and indicators provided by EnduCloud — including but not limited to Training Stress Scores (STRSS), Acute:Chronic Workload Ratios, readiness scores, heart-rate zones, power zones, and pace zones — are informational estimates only. They are computed algorithmically from data you provide and may be inaccurate or inappropriate for your individual circumstances.

Before starting, modifying, or significantly increasing any exercise programme, you should consult a qualified physician, physiotherapist, or licensed sports coach. EnduCloud does not replace professional medical or athletic guidance.

Health screening. Before EnduCloud provides you with training content you complete a short pre-participation health screening: seven yes/no questions about heart conditions and blood pressure, chest pain, dizziness or loss of consciousness, chronic conditions, prescribed medication, musculoskeletal problems, and any physician's instruction to exercise only under supervision. Your answers are recorded with their date and version; you can review and update them at any time in Settings, and you agree to keep them accurate when your health changes. A positive answer does not prevent you from using EnduCloud. It means you should consult a physician before starting or increasing training, and, for chest pain or a physician's instruction to exercise only under supervision, that you should not start or increase training until a physician has assessed you. Where your answers are positive, EnduCloud's coaching features take them into account; they do not have your medical history and are not a substitute for your physician's advice.

Supervised programmes. If you take part in EnduCloud through a clinician-supervised programme, the terms of that programme and your clinician's instructions govern your medical clearance. The screening above still applies to you and should be answered truthfully.

Methodology revisions. Sports science and our own models evolve. We revise how metrics are computed (for example training-load, readiness, zone and fitness models) as evidence and data improve, and such a revision may recompute your historical values. A change in a historical number after a revision is a change in the estimate, not in what you did.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND.

To the fullest extent permitted by applicable law, EnduCloud expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

8. Limitation of Liability

CAP ON LIABILITY. To the fullest extent permitted by applicable law, EnduCloud's total aggregate liability to you for all claims arising out of or in connection with these Terms or the service, in any twelve-month period, shall not exceed the greater of (a) the fees you paid to EnduCloud in the twelve months preceding the event giving rise to the claim and (b) €100.

What is never excluded. Nothing in these Terms excludes or limits EnduCloud's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection law in your country of residence. Where that law gives you rights these Terms cannot override, those rights prevail.

Subject to the paragraph above, and to the fullest extent permitted by applicable law, EnduCloud, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for:

10. Use of Data for Improvement & Research

EnduCloud may use your data, in aggregated or pseudonymised form, to:

Pseudonymised, not anonymised. Longitudinal training and health data (heart rate, sleep, routes) is hard to anonymise irreversibly, and we do not claim that it is. Data used for improvement is pseudonymised: direct identifiers are replaced by a key that only EnduCloud holds and never shares. Pseudonymised data remains personal data and is protected as such under our Privacy Policy. We do not sell your data.

EnduCloud may additionally make aggregated or pseudonymised data available to academic researchers studying topics directly relevant to endurance sports and human health — such as activity habits, sleep patterns, training load, and physiological adaptation. Any such access is subject to all of the following conditions: (i) the research is conducted under a formal ethics approval issued by a recognised institution in accordance with the Declaration of Helsinki (or an equivalent national research ethics framework); (ii) the data provided carries no direct identifiers and the re-identification key is never shared with the researcher; (iii) the research is non-commercial and its findings are intended for public benefit; and (iv) the researcher is bound in writing not to attempt re-identification and not to pass the data on. This reflects EnduCloud's commitment to giving back to the scientific community that underpins endurance sport and human performance research.

On termination, your licence to use the service immediately ceases. Sections 7 (Warranties), 8 (Liability), 14 (Governing Law), and any other provisions that by their nature should survive, shall survive termination.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the application and require you to re-accept before continuing to use the service. Continuing to use EnduCloud after a required re-acceptance constitutes agreement to the revised Terms. Version 1.2 (September 1, 2026) is such a material change: it replaced the earlier "zero liability because the service is free" cap with the cap and carve-outs in Section 8, moved the health declaration to the recorded screening in Section 5, and added the methodology-revision clause.

The version number and "Last updated" date at the top of this page indicate the current revision.

14. Governing Law & Jurisdiction

These Terms are governed by, and construed in accordance with, the laws of the State of Israel, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Tel Aviv, Israel.

If you are a resident of the European Union, you also have the right to bring a dispute before the courts of your country of residence.
