- We make no uptime, availability, or performance commitments;

5. Fitness & Health Disclaimer
Important: EnduCloud is a sports analytics tool. It is
not a medical device, and nothing within the service constitutes
medical advice, clinical diagnosis, treatment, or professional coaching.
All metrics, scores, and indicators provided by EnduCloud — including but not limited to
Training Stress Scores (STRSS), Acute:Chronic Workload Ratios, readiness scores,
heart-rate zones, power zones, and pace zones — are informational estimates only.
They are computed algorithmically from data you provide and may be inaccurate or
inappropriate for your individual circumstances.
Before starting, modifying, or significantly increasing any exercise programme,
you should consult a qualified physician, physiotherapist, or licensed sports coach.
EnduCloud does not replace professional medical or athletic guidance.
By using EnduCloud, you acknowledge that:
- Exercise carries inherent risk of injury, illness, or death;
- You are solely responsible for assessing whether any training load, plan, or recommendation is safe and appropriate for you;
- EnduCloud is not responsible for any injury, illness, or adverse health outcome arising from use of the service; and
- You will immediately stop exercise and seek medical attention if you experience chest pain, dizziness, difficulty breathing, or any other concerning symptom.
6. AI Coaching ("Endy") Disclaimer
EnduCloud includes an AI assistant called "Endy" that generates training suggestions,
coaching feedback, and plan recommendations. You acknowledge that:
- Endy's responses are generated automatically by a large-language-model AI and are not reviewed or verified by a human coach;
- Endy does not know your full medical history, current health status, or individual risk factors;
- AI-generated suggestions may be incorrect, incomplete, outdated, or unsuitable for your circumstances;
- You must not follow any AI suggestion that conflicts with advice from a qualified medical or coaching professional; and
- You use Endy's suggestions entirely at your own risk.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY
OF ANY KIND.
To the fullest extent permitted by applicable law, EnduCloud expressly disclaims all
warranties, whether express, implied, statutory, or otherwise, including but not
limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
- Any warranty that the service will be uninterrupted, secure, or error-free;
- Any warranty as to the accuracy, reliability, completeness, or timeliness of any metric, score, recommendation, or AI output;
- Any warranty that defects will be corrected; and
- Any warranty that the service is free of viruses or other harmful components.
8. Limitation of Liability
MAXIMUM LIABILITY: ZERO. Because the service is provided
free of charge during the pilot, EnduCloud's total aggregate liability to you
for any claim arising out of or related to these Terms or the service
shall not exceed zero (€0 / ₪0).
To the fullest extent permitted by applicable law, in no event shall EnduCloud,
its directors, employees, partners, agents, suppliers, or affiliates be liable for:
- Any indirect, incidental, special, punitive, exemplary, or consequential damages;
- Loss of data, profits, revenue, goodwill, or business opportunities;
- Physical injury or illness, including death, arising from exercise undertaken in connection with the service;
- Damages arising from reliance on AI-generated coaching advice or training metrics;
- Service interruption, data loss, or unauthorised access to your data;
- Any bug, error, or inaccuracy in any metric, score, or training plan.
This limitation applies regardless of the theory of liability (contract, tort,
negligence, strict liability, or otherwise) and even if EnduCloud has been
advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain warranties
or liability. In such jurisdictions, EnduCloud's liability is limited to the
minimum extent permitted by law.
9. Your Data & Privacy
Your personal data is processed in accordance with our
Privacy Policy, which is incorporated into
these Terms by reference. Key points:
- We process your fitness and profile data to provide the service;

- You may request deletion of your account and data at any time by emailing privacy@enducloud.com.

anonymised form, to:
- Improve the accuracy of performance metrics and machine-learning models;
- Validate algorithmic approaches to training load and readiness scoring;

Anonymised data will not contain personally identifiable information. We will
not sell your identifiable data to third parties.
EnduCloud may additionally make aggregated, anonymised data available to
academic researchers studying topics directly relevant to endurance sports and
human health — such as activity habits, sleep patterns, training load, and
physiological adaptation. Any such access is subject to all of the following
conditions: (i) the research is conducted under a formal ethics approval
issued by a recognised institution in accordance with the
Declaration of Helsinki (or an equivalent national research ethics
framework); (ii) the data provided cannot be linked back to any individual
user; and (iii) the research is non-commercial and its findings are intended
for public benefit. This reflects EnduCloud's commitment to giving back to
the scientific community that underpins endurance sport and human performance
research.

account deletion by contacting privacy@enducloud.com.
By EnduCloud: We may suspend or terminate your access at any time,
with or without notice, for any reason, including but not limited to:
- Breach of these Terms;

On termination, your licence to use the service immediately ceases.
Sections 7 (Warranties), 8 (Liability), 14 (Governing Law), and any other
provisions that by their nature should survive, shall survive termination.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will
notify you via the application and require you to re-accept before continuing to
use the service. Continuing to use EnduCloud after a required re-acceptance
constitutes agreement to the revised Terms.
